PURPOSE
Article 23-A of the Zoning Ordinance of the City of Flint Hill, Missouri (the “City”), provides for the establishment of the City's Architectural Review Board (the “ARB”).The purpose of the ARB is to review, comment and act upon design, function and aesthetic issues and elements relative to all buildings and structures to be constructed in the Downtown Special District (the “DSD”). The ARB hereby establishes appropriate standards and regulations to implement Article 23-A. These standards and regulations are designed to serve as guidelines for construction in the DSD. SECTION 1. Article 30 of the Zoning Ordinance is amended by adding a new Section 30.05-A as follows:
30.05-A SIGNS IN DSD-DOWNTOWN SPECIAL DISTRICT. Shall be, on each lot and each structure, located in compliance with the regulations of Section 30.04 (Residential) or Section 30.05 (Commercial) according to the use, residential or commercial, of the lot and structure.
A. Allowable Signs. All signs within this zoning district are subject to review and must be approved by the Architectural Review Board (ARB) as provided herein, except Political Signs under Article 30.04(6), Property Real Estate Signs under Article 30.04(9), and Special Display and Other Temporary Signs under Article 30.04(10) are not subject to review and approval by ARB.
1. All signs permitted and regulated in Articles 30.04 and 30.05 are permitted subject to review and approval as stated herein.
2. ARB review and approval shall be limited to the design mounting, location, materials, appearance and character of signage and shall not extend to content, and considering all of the following factors which are not listed in priority and not otherwise limited by the identification of permissible and allowable signage as contained in this Article:
a. In the case where design, color or materials proposed to be used is material to the applicant's business, as established by trademark or copyright or other established use, the ARB shall work with the Applicant to ensure as much consistency with the unique and historic character and attributes of the area identified as the historic center of the City of Flint Hill, but ARB shall not approve design, color and materials inconsistent with the unique and historic character and attributes of the area identified as the historic center of the City; and
b. Review of appearance, lighting, mounting and location of signage shall take into consideration sight-lines, aesthetic appeal, colors and designs and shall be consistent with the unique and historical character and attributes of the area identified as the historic center of the City, as may be evidenced in materials documenting the historical appearance, lighting, mounting and location or otherwise established; and
c. The use of materials, including lighting, the placement, location and mounting of the sign shall be consistent with the unique and historic character and attributes of the area identified as the historic center of the City of Flint Hill.
3. Review of an application by the City Engineer shall be limited to safety issues relating to design, components, materials and construction, safety issues relating to placement relative to streets, setbacks, crossings, utilities and other structures to ensure safe sight distances and views.
